AgroFresh Solutions, a provider of pre-harvest and post-harvest horticultural technologies, said the US District Court in Delaware ruled that AgroFresh is the owner of US Patent No. 9,394,216 technology — the core technology used in the product marketed as TruPick.
“This judgment resolves a key aspect of the litigation filed by AgroFresh against its former consultant, MirTech, and MirTech’s principal shareholder, Nazir Mir,” said AgroFresh.
“In its opinion, the court held that the relevant sections of the agreements between the parties were ‘clear and unambiguous’ and that under the terms of those agreements, MirTech automatically assigned to AgroFresh the ‘216 patent technology.”
AgroFresh CEO Jordi Ferre said: “We are pleased that the court validated AgroFresh’s claim of ownership to the ‘216 patent technology.

AgroFresh said it will now pursue its remaining claims in court, including a damages claim.
