Blacklidge Emulsions, a producer and distributor of asphalt products, said the Patent Trial and Appeal Board (PTAB) of the US Patent and Trademark Office (USPTO) ruled in its favor in two Inter Partes Reviews (IPRs) proceedings and upheld Blacklidge’s patents covering non-tracking tack coat technology.
“All claims of the two patents challenged by Colas Solutions, Inc. remain valid and enforceable,” said Blacklidge.
“The patents, U.S. Patent Nos. 7,503,724 and 7,918,624, relate to methods of providing a tack coat between pavement layers and describe quick-curing asphalt emulsions that do not stick to vehicle tires while maintaining bond strength on treated paving surfaces.”
Blacklidge Emulsions CEO Brittany Blacklidge said: “We are very pleased with the decisions by the PTAB, which confirms our long-held position that the non-tracking tack coat patents are valid.
“We have great confidence in our existing product line and we will continue to develop new high-performance asphalt products for our valued customers in the road construction industry.”
